In Germany, the Federal Court of Justice (BGH) made a important decision: Price comparison websites have to state if they only display offers of traders who pay them a commission.
The defendant was a German website that provides comparison of undertakers. It was unclear that not all companies were displayed, but only those who had a commission agreement with the provider of the website. According to the Court, the website withheld essential information from consumers.
The verdict is also affecting other (German) price comparison providers who made such agreements with companies. In order to avoid similar lawsuits, they should be more transparent about the range of their comparisons in the future.
